Welcome to HMSTOCK. These Terms of Service ("Terms") govern your access to and use of the website hmstock.store(the "Site"), and any products or services offered through it. The Site is operated by HM Service Co LLC("HMSTOCK," "we," "us," or "our"), based in Atlanta, Georgia, United States.

By visiting our Site, creating an account, or placing an order, you agree to these Terms and our Privacy Policy and Refund Policy. If you do not agree, please do not use the Site.

1. Eligibility

To use our Site or make a purchase, you must:

  • Be at least 18 years old and able to enter a binding contract under the laws of your jurisdiction
  • Provide accurate and complete information when placing an order
  • Not be prohibited from using our services under applicable law

By placing an order, you confirm that you meet these eligibility requirements.

2. Your Account

You may create an account to track orders and save preferences. You're responsible for:

  • Keeping your password and account credentials confidential
  • All activity that occurs under your account
  • Notifying us immediately at support@hmservices.llc if you suspect unauthorized use

We reserve the right to suspend, restrict, or terminate accounts that violate these Terms, engage in fraudulent or abusive behavior, file excessive chargebacks, or otherwise harm our business or other customers — at our sole discretion and without prior notice.

3. Products, Pricing & Availability

Product Information

We do our best to display products accurately. However:

  • Colors and details may appear differently on different screens or devices
  • Slight variations between product images and the item received are possible
  • We do not guarantee that product descriptions, specifications, or content are completely accurate, current, or error-free

Marketplace / Reseller Disclosure

HMSTOCK operates as a curated retailer and marketplace. We do not manufacture the products sold on our Site.Products are sourced from third-party suppliers, manufacturers, and fulfillment partners. We rely on information provided by these third parties — including product descriptions, images, materials, and specifications — and present that information to our customers in good faith.

Because we are a reseller and not the manufacturer:

  • Any product warranties, guarantees, or representations beyond what is expressly stated on our Site come from the original manufacturer, not HMSTOCK
  • We do not provide express or implied warranties beyond those required by applicable law
  • Your sole remedy for product defects, dissatisfaction, or accuracy issues is the process described in our Refund Policy
  • HMSTOCK's responsibility is limited to delivering the product as described to the best of our reasonable ability

Pricing

  • All prices are listed in U.S. Dollars (USD)
  • Prices are subject to change without notice
  • Prices do not include applicable taxes or shipping costs, which are added at checkout
  • Promotions, discounts, and sale pricing are time-limited and may be modified or ended at any time at our discretion

Pricing Errors

We reserve the right to cancel any order placed at an incorrect price, regardless of whether the order has been confirmed and your payment method has been charged. If we cancel an order due to a pricing error, we will issue a full refund to your original payment method. We are not obligated to honor pricing errors, typographical errors, or system glitches that result in incorrect pricing.

Right to Limit or Refuse Orders

We reserve the right to limit quantities, refuse orders, or cancel orders at our sole discretion, including (but not limited to) orders that:

  • Appear fraudulent or unauthorized
  • Are placed by automated tools, bots, or scripts
  • Violate these Terms
  • Exceed reasonable purchase quantities (such as suspected resale or scalping activity)
  • Are placed using stolen payment methods or compromised accounts

If we cancel your order under this section, we will refund any charges to your original payment method.

Availability

Most items are sourced or made-to-order through our suppliers, and stock levels can change quickly. If an item becomes unavailable after your order is placed, we will notify you and issue a full refund.

4. Orders & Payment

Placing Orders

When you place an order, you are making an offer to purchase. We confirm orders by email. Order confirmation does not guarantee acceptance — we reserve the right to accept or decline any order at our discretion.

Payment

We accept major credit cards, debit cards, Apple Pay, Google Pay, Shop Pay, PayPal, and other methods listed at checkout. By providing payment information, you confirm that you are authorized to use that payment method.

You authorize HMSTOCK and our payment processors to charge your selected payment method for the total order amount, including taxes and shipping.

Currency

All transactions are processed in U.S. Dollars (USD). We do not currently support multi-currency checkout.

Taxes

Sales tax will be added to your order based on your shipping address where applicable.

5. Shipping & Delivery

We currently ship within the United States only. See our Shipping Policy for full details on rates, processing times, and delivery.

  • Estimated shipping and delivery times are not guaranteed
  • We are not responsible for delays caused by carriers, weather, or other circumstances outside our control
  • Risk of loss transfers to you when the carrier accepts the package

6. Returns & Refunds

See our Refund Policy for full details. In summary:

  • 14 days from delivery to request a return on eligible items
  • Customer is responsible for return shipping
  • Sale items, custom/personalized items, and other listed exclusions are final sale
  • Refunds are processed within 10 business days of receipt and approval

7. Intellectual Property

Our Content

All content on the Site — including but not limited to the HMSTOCK name, logos, brand marks, product photography, copy, designs, layouts, code, graphics, and any other content — is owned by HM Service Co LLC or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes only.

You may not:

  • Copy, reproduce, modify, distribute, or republish our content
  • Use our trademarks, logos, brand assets, or product photography without prior written permission
  • Reverse engineer, scrape, data-mine, or systematically extract content from our Site
  • Use our content to train artificial intelligence models or machine learning systems
  • Use our content for commercial purposes, including reselling, advertising, or competing services
  • Remove or alter any copyright, trademark, or other proprietary notices

Personal social media sharing of HMSTOCK content (such as reposting product images with credit) is permitted, provided the use is non-commercial and does not modify the content.

User-Submitted Content

If you submit any content to the Site or through our channels — including reviews, photos, comments, testimonials, or messages ("User Content") — you grant HMSTOCK a perpetual, worldwide, royalty-free, non-exclusive, transferable, and sublicensable license to use, display, reproduce, modify, distribute, and create derivative works from that content for any purpose, including marketing, advertising, social media, and promotional materials, without compensation or further notice to you.

By submitting User Content, you represent and warrant that:

  • You own the content or have the necessary rights to grant this license
  • The content does not infringe on any third party's intellectual property, privacy, or other rights
  • The content is truthful, accurate, and not misleading
  • The content does not contain unlawful, defamatory, abusive, or otherwise objectionable material

Reviews

We welcome honest customer reviews. We reserve the right to remove or refuse to publish reviews that are:

  • Fake, fraudulent, or AI-generated
  • Spam, off-topic, or unrelated to the product
  • Abusive, threatening, profane, or harassing
  • Containing personal information of others
  • Promoting competing products or services
  • In violation of any law or third-party rights

We do not remove reviews simply for being negative. Genuine, honest negative reviews are part of our commitment to transparency.

8. Acceptable Use

You agree not to use the Site to:

  • Engage in any unlawful, fraudulent, or harmful activity
  • Violate any applicable local, state, federal, or international law or regulation
  • Harass, threaten, defame, abuse, or harm any person or entity
  • Submit false, misleading, or fraudulent information (including in orders, returns, or chargebacks)
  • Impersonate any person or entity
  • Interfere with or disrupt the Site, servers, or networks
  • Attempt to gain unauthorized access to any part of the Site, accounts, or systems
  • Use bots, scrapers, crawlers, or automated tools without written permission
  • Transmit viruses, malware, or harmful code
  • Engage in any activity that could damage, disable, or impair the Site

Violation of this section may result in immediate account termination, order cancellation, refusal of future service, and/or legal action.

9. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS, SERVICES, AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, HM Service Co LLC and HMSTOCK disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability
  • Implied warranties of fitness for a particular purpose
  • Warranties of non-infringement
  • Warranties that the Site will be uninterrupted, error-free, secure, or free of viruses
  • Warranties regarding the accuracy, reliability, or completeness of any content, product description, or information

Some jurisdictions do not allow the exclusion of certain warranties. To the extent any warranty cannot legally be excluded, it is limited to the minimum duration and scope permitted by applicable law.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL HM SERVICE CO LLC, HMSTOCK, OR THEIR OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, exemplary, or punitive damages
  • Lost profits, lost revenue, lost data, or business interruption
  • Personal injury, property damage, or any other damages arising from your use of the Site or any product

HMSTOCK'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR ANY PRODUCT IS LIMITED TO THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS LESS.

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if HMSTOCK has been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless HM Service Co LLC, HMSTOCK, and their owners, officers, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or related to:

  • Your use of the Site or any product
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of any third-party right (including intellectual property, privacy, or contractual rights)
  • Any User Content you submit
  • Any false or fraudulent information you provide

This obligation will survive the termination of these Terms or your account.

12. Dispute Resolution & Arbitration

Informal Resolution First

If you have a dispute with HMSTOCK, you agree to first contact us at support@hmservices.llc and attempt to resolve the issue informally. Most disputes can be resolved this way without arbitration or court.

Binding Arbitration

If we cannot resolve a dispute informally within 60 days, you and HMSTOCK agree to resolve the dispute through binding arbitration rather than in court, except for the small-claims and equitable-relief carve-outs below.

  • Arbitration will be conducted by a neutral arbitrator under the rules of the American Arbitration Association (AAA)
  • Arbitration will take place in Atlanta, Fulton County, Georgia, or via video conference at the arbitrator's discretion
  • The arbitrator's decision will be final and binding
  • Each party is responsible for its own arbitration costs unless the arbitrator awards otherwise

Carve-Outs (When You Can Still Go to Court)

You retain the right to bring claims in:

  • Small claims court for disputes within that court's jurisdictional limits (typically claims under $10,000)
  • Court for injunctive or equitable relief to protect intellectual property or trade secrets

Class Action Waiver

YOU AND HMSTOCK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

The arbitrator may not consolidate or join more than one person's claims and may not award class-wide or representative relief.

If this class action waiver is found unenforceable, the entire arbitration agreement will be void, but the rest of these Terms will remain in effect.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-law principles.

For any dispute not subject to arbitration, you and HMSTOCK consent to the exclusive jurisdiction and venue of the state and federal courts located in Fulton County, Georgia.

14. Modifications to These Terms

We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. The current version will always be posted on this page with an updated "Last updated" date.

Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Site.

15. Termination

We may suspend, restrict, or terminate your access to the Site or your account at any time, with or without notice, for any reason — including (but not limited to) violation of these Terms.

Sections that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law — will continue to apply after termination.

16. Severability

If any provision of these Terms is found by a court or arbitrator to be unenforceable, illegal, or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, or severed entirely if it cannot be made enforceable. The remaining provisions will continue in full force and effect.

17. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. A waiver of any provision will only be effective if made in writing and signed by an authorized representative of HMSTOCK.

18. Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. HMSTOCK may freely assign these Terms in connection with a sale, merger, or other corporate transaction.

19. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and HMSTOCK regarding the Site and your use of our products and services. They supersede any prior agreements or understandings.
